Terms of Use of the www.govic-company.hr website and its subpages

1. Introduction and Acceptance of the Terms

The website www.govic-company.hr is owned by Govic Company d.o.o. (hereinafter: Govic Company). By using the Govic Company Online Shop and all associated pages and services (hereinafter: the Online Shop), you acknowledge that you have read, understood and agree to these Terms of Use (hereinafter: the Terms).

By accessing and/or using the domain www.govic-company.hr and its subdomains, content (photos, text, graphics, documents, data), applications, software and services, the user expressly agrees to use the Online Shop in accordance with these Terms and applicable regulations.

Users are required to review the Terms regularly; continued use constitutes acceptance of the current version of the Terms.

2. Changes and Service Availability

Govic Company reserves the right to amend these Terms, the content or the services of the Online Shop, and to partially or fully restrict access—especially in case of a breach of the Terms. All changes take effect upon publication on this website and apply only to future use.

3. Intellectual Property and Permitted Use

All content on the Online Shop (text, photos, graphics, logos, documents, data, design, etc.) is protected by copyright and/or intellectual property rights of Govic Company and/or its partners.
Without prior written consent from Govic Company, it is prohibited to reproduce, distribute, modify, publicly display, transmit, sell or otherwise exploit the content and visual identity of the Online Shop, unless expressly permitted by these Terms. Storing or copying content for commercial purposes is not allowed.

In case of unauthorised use of the content, Govic Company may claim damages and initiate appropriate proceedings against the responsible party.

4. Website Use and Prohibited Conduct

You may not use the Online Shop in any manner that is contrary to these Terms and applicable law, including (but not limited to): sending unsolicited electronic communications (spam), compromising system security, infringing third-party rights, impersonation or using someone else’s data.
The user warrants they will use any downloaded content lawfully; any contrary use is unauthorised and may result in restricted access and/or liability for damages.

5. Registration and User Account

Registration/use of a user account is intended for one natural or legal person. By registering, the user chooses a username and a secure password and provides accurate, valid and complete information, which they must keep up to date. A user account is non-transferable.
Opening an account is not required to make a purchase. Ordering and purchasing may be carried out by adults with full legal capacity; purchases on behalf of minors may be made only by their legal representatives/guardians, and persons with limited capacity may purchase with the consent of their representative — all in line with the Terms of Purchase.

It is expressly forbidden to: use another person’s data, impersonate others, disclose access credentials to third parties or send unsolicited messages via the Online Shop. In case of a breach, Govic Company may refuse registration or terminate the account without any obligation to compensate.

6. Liability and Disclaimer of Warranties

The Online Shop and its content are provided “as is” and “as available”. Govic Company strives to publish accurate and up-to-date information but does not guarantee completeness, timeliness or availability.
To the maximum extent permitted by applicable law, Govic Company shall not be liable for damages arising from the use or inability to use the Online Shop, except in case of intent or gross negligence. This disclaimer does not affect consumer statutory rights under the Terms of Purchase, warranty, and conformity rules.

7. External Links and Third-Party Content

The Online Shop may contain links to third-party websites. Govic Company does not control those sites and is not responsible for their content, privacy policies or practices.

8. Privacy and Cookies

The processing of personal data is governed by Govic Company’s Privacy Policy; the use of cookies is governed by the Cookie Policy. The Online Shop does not store card numbers; card payments are processed by an authorised payment gateway (e.g., Monri WSPay: Web Secure Payment Gateway) on its secure pages (SSL/TLS, 3-D Secure).

Note on consistency with the Terms of Purchase and Payment Methods: All details on payment, delivery, right of withdrawal and complaints are set out in the Terms of Purchase. These Terms of Use do not modify or limit statutory consumer rights provided in the Terms of Purchase.

9. Loyalty Programme (Go-WinCoins)

General
a) By joining the loyalty programme (the Programme), you accept these rules. The Programme is intended for customers of www.govic-company.hr. Points have no cash value outside the Programme, cannot be redeemed for cash and may be revoked in accordance with the Programme rules.
b) Participants’ personal data are processed in accordance with the Privacy Policy.

Membership
a) You become a member by opening a user account at www.govic-company.hr.
b) Govic Company may exclude a member who uses the Programme contrary to the rules; exclusion may result in the loss of accumulated points.

Earning points
a) For each purchase on www.govic-company.hr, members earn points, typically 2–8% of the net value of the ordered goods (excluding delivery). The exact calculation is shown in the cart and/or profile.
b) Any initial bonus points (if offered) are credited once upon account activation.
c) Points are credited 1–2 business days after the payment is recorded. For purchases with deferred payment, points are not credited before proper settlement. If part of an order is paid with points/Programme discount, no new points accrue on that part.
d) Points previously accrued in HRK up to 31 Dec 2022 were converted to EUR at the fixed rate 1 EUR = 7.53450 HRK, subject to minor rounding.

Validity of points
a) Your balance and expiry date are visible in your profile.
b) Points remain valid until 31 December of the year following the year they were earned (e.g., points from 2025 are valid until 31 Dec 2026). Unused points automatically expire.

Redeeming points
a) Points may be used to reduce the order value at checkout after you sign in.
b) Up to 80% of a single order value may be paid with points (unless otherwise stated in a promotion).
c) Minimum redemption thresholds and membership tiers (e.g., VIP) are defined and published in the Programme interface; Govic Company may adjust them and will notify members via the website and/or e-mail.

Programme changes
Govic Company may amend, suspend or discontinue the Programme (in whole or in part) with notice on the Programme pages. Changes apply to future earning and redemption.

10. Governing Law, Dispute Resolution and Contact

These Terms are governed by the laws of the Republic of Croatia. The parties will attempt to resolve disputes amicably; otherwise, the competent court at the registered seat of Govic Company d.o.o. shall have jurisdiction.
A written consumer complaint may be submitted by e-mail to [email protected] or by post to the company address; Govic Company will reply in writing within 15 days of receipt.
