TERMS OF PURCHASE VIA THE “GOVIC COMPANY” ONLINE SHOP

1. GENERAL PROVISIONS

The holder of all rights to the internet domain www.govic-company.hr is the company Govic Company d.o.o. By using the services of the Govic Company Online Shop and all associated pages on the domain www.govic-company.hr, consumers are deemed to be familiar with these Terms of Purchase (hereinafter: the Terms) at all times and to fully understand and accept them. These Terms apply to the rights and obligations related to purchasing products via the Govic Company Online Shop, as well as to the rights and obligations arising from the conclusion of a distance sales contract (hereinafter: the Contract) between the consumer as the end customer and the Govic Company Online Shop, and are considered an integral part of such contracts.

The provider of online sales services via the Govic Company Online Shop is Govic Company d.o.o., registered office: Drenovski put 41, 51000 Rijeka, OIB: 69848131449.

Users are advised to familiarise themselves with the Terms of Sale before purchasing and to check them regularly so as to be aware of their rights and obligations. Govic Company d.o.o. reserves the right to amend these Terms. All amendments take effect upon publication on this website and apply exclusively to new orders placed after the amendments are published.

Govic Company d.o.o. reserves the right to discontinue services, change content and other services and subpages that form an integral part of the Govic Company Online Shop, as well as to change, limit or cease providing services at any time without prior notice. It may also fully or partially restrict access to users who breach these Terms. Such changes take effect upon publication on this website.

Use of the Govic Company Online Shop services is permitted to adults only. Use by minors is not permitted; parents and/or guardians are required to ensure compliance. Otherwise, they assume all rights and obligations arising from such use, and Govic Company d.o.o. shall not be liable for any consequences. Purchases via the domain www.govic-company.hr on behalf of and for the account of minors or persons lacking full legal capacity may be concluded only by their legal representatives, while persons with limited legal capacity may conclude a contract only with the consent of their legal representative.

The Govic Company Online Shop (i.e., Govic Company d.o.o.) disclaims liability for the accuracy and/or completeness of all information and content found on the domain www.govic-company.hr. The Online Shop reserves the right to errors in product descriptions and images. Product images are illustrative in nature and may differ from the actual appearance of the product. Certain product photos, especially those relating to colour shades, may differ from the actual product due to the seller’s technical display capabilities on the website. The binding information is the product description and technical specifications stated in the offer. The Govic Company Online Shop will endeavour to publish accurate and up-to-date data on www.govic-company.hr, but does not assume responsibility for their completeness and accuracy.

2. ONLINE PURCHASING VIA THE “GOVIC COMPANY” ONLINE SHOP

Conclusion and termination of the sales contract

These Terms, as well as any product-specific terms indicated alongside information about particular products, constitute an offer by Govic Company d.o.o. to conclude a contract. The user, as the Customer, accepts the offer by registering, placing an order, or in another manner provided in these Terms, whereby a contract is deemed concluded between the Customer and Govic Company d.o.o., in accordance with the conditions stated in these Terms.

By registering in the Govic Company Online Shop and/or subscribing to the newsletter, the user gives consent for the Govic Company Online Shop to notify them by e-mail about news, promotions and changes related to products and services. The user may unsubscribe from the newsletter list at any time.

The purpose of the contract is the purchase of the selected product via the Govic Company Online Shop, with payment of the corresponding product price and the associated delivery costs. The contract is concluded by means of distance communication (a distance contract) via an online order in the Govic Company Online Shop, printed promotional messages with an order form, or by telephone with human assistance.

After successful registration (all required data correctly entered), a notification of successful registration will be sent to the user’s e-mail address.

Products available for purchase are listed on the domain www.govic-company.hr. For each product, information on specifications, price and delivery terms (section “Delivery”) is provided. All prices are expressed in euros (EUR) including VAT.

Before concluding a contract, the user can review the Terms of Purchase by clicking on the “Terms of Purchase” section. The contract is deemed concluded when the Customer receives an order confirmation by e-mail (confirmation on a durable medium), and the payment obligation arises according to the selected payment method.

The Customer may place an order as follows:

• by completing an order as a registered user of the Govic Company Online Shop,

• by completing an order as a guest user of the Govic Company Online Shop,

• by completing/modifying an order by telephone at 051/301-058 (Mon–Fri 9:00–19:00); other enquiries: [email protected].

During registration or when creating a user account, the user must choose a username and secure password and provide a valid e-mail address. All data must be truthful; the use of another person’s data is prohibited.

A user account is created for one natural person and it is not permitted to disclose login credentials to third parties. The user must keep their credentials confidential. Use of another person’s account is not permitted.

In the event of a breach of these provisions, Govic Company d.o.o. reserves the right, at its discretion, to disable the user account without any obligation to compensate the user.

Contract confirmation and right of unilateral withdrawal

An electronic order confirmation will be delivered to the Customer containing all information required for distance contracts, including notice of the right of unilateral withdrawal and a withdrawal form. The Customer has the right, without stating reasons, to withdraw from the contract within 14 days from the day the goods were handed over into the possession of the Customer or a person designated by the Customer, who is not the carrier.

To exercise this right, the Customer must, before the deadline, notify Govic Company d.o.o. of the decision to withdraw:

• by post (Govic Company d.o.o., Franje Račkog 10, 51000 Rijeka) or

• by e-mail at [email protected].

The Customer may use the withdrawal form available on the website under “Terms of Purchase.” If the withdrawal is sent electronically, Govic Company d.o.o. will, without delay, provide confirmation of receipt of the withdrawal statement on a durable medium.

In the event of withdrawal, Govic Company d.o.o. will refund all payments received, including delivery costs for the basic cheapest offered delivery, without undue delay and no later than 14 days from the day it receives the withdrawal notice. The refund may be withheld until the goods are returned or until proof is provided that the goods have been sent back, whichever occurs earlier. The refund will be made using the same means of payment used by the Customer, unless the Customer expressly agrees otherwise, without additional costs.

The Customer must return the goods without undue delay and no later than 14 days from the day they informed the trader of the withdrawal, to: Govic Company d.o.o. (Online Shop), Franje Račkog 10, 51000 Rijeka. The direct costs of returning the goods are borne by the Customer, unless the trader has agreed to bear such costs or failed to inform the Customer of this obligation. The Customer is liable for any diminished value of the goods resulting from handling other than what is necessary to establish the nature, characteristics and functioning of the goods.

If, at the Customer’s explicit request, performance of the service began before the expiry of the withdrawal period, the Customer must pay a proportionate amount of the price for what was provided up to the moment of notifying the withdrawal.

PURCHASE PROCESS

The essential characteristics of products (description and specifications), prices, special promotions/benefits, and payment and delivery methods apply as valid at the time the order is placed and are indicated with each product. The total price, including VAT and delivery costs, is clearly shown in the cart before order confirmation. The purchase confirmation and all key information are sent to the Customer’s e-mail address provided during the ordering process.

Govic Company d.o.o. treats products placed in the cart as an order and reserves the right to cancel it for justified reasons. In case of cancellation, the Customer will be notified by e-mail or telephone.

If the Customer does not receive the order confirmation, they may contact us at [email protected] or 051/301-058 (Mon–Fri 9:00–19:00) to check the status.

By clicking “I accept the Terms of Purchase,” the Customer confirms that before concluding the contract they were informed of the key information about the trader, the product, price, delivery, right of withdrawal, liability for lack of conformity and warranty.

PAYMENT METHODS

Payment of the product price and delivery costs is possible:
a) cash on delivery (with prior notice at 051/301-058). Note: for the categories “Industrial sewing machines,” “Handy Quilter,” “Professional embroidery machines” and partially “Ironing systems / irons,” cash on delivery is not available;
b) cards (Diners, American Express, MasterCard, Maestro, Visa);
c) general payment slip/bank transfer (payment at a bank/FINA/Croatian Post);
d) online banking.

For payments by quote/order (payment slip/online banking) the Customer receives by e-mail all data required to make the payment; payments should be made within 3 days. Card payments are processed on the secure SSL pages of authorised payment service providers.

“Receipt of funds” means receipt of the payment to the Govic Company d.o.o. business account or authorisation of the card transaction.

PRICES AND DELIVERY TERMS

The delivery cost is calculated automatically and shown before order confirmation, depending on weight, volume and delivery zone. Delivery is performed by contracted partners (e.g., GLS, DPD Croatia d.o.o., Box Now, Gebrüder Weiss d.o.o.).

Products marked “in stock” are generally delivered within 5–7 business days from payment being recorded, with exceptions where retrieval from other warehouses or sales units is required (of which the Customer will be duly informed).

If a particular product cannot be delivered, we will contact the Customer to arrange a replacement or partial/complete cancellation.

EXCHANGES, COMPLAINTS, OBJECTIONS AND LIABILITY

For product exchange or to report a defect: 051/301-058 or [email protected].

Products are packed to prevent damage under normal handling. Recommendation: upon receipt, inspect the parcel; if the packaging is visibly damaged, ask the courier to return the parcel and record the reason. If the packaging is undamaged, open it carefully and keep it until the expiry of the withdrawal period.

A written objection/complaint may be submitted in writing (e-mail or post) or by telephone. We will respond to a written complaint in writing within 15 days from receipt, clearly stating whether the complaint is accepted. In case of a justified complaint, we will provide repair, replacement, price reduction or contract termination with a refund, in accordance with the rules on liability for lack of conformity.

The Customer is liable for any diminished value of the goods resulting from handling beyond what is necessary to determine the nature, characteristics and functionality. (Tip: test the product only to the minimum necessary; do not remove protective foils/seals unless you are sure you will keep the product.)

Return conditions – deductions from the refund depending on packaging/accessories

(Accessories include: manuals (printed or on media), cables, basic and additional accessories and all other items supplied with the product. Percentages may be cumulative if multiple elements are missing. The deduction is determined individually, proportionate to the actual diminished value.)

* Spare parts: returns are not possible if the goods are made to specification or clearly customised for the Customer, or if a part has already been installed/visibly used (exceptions per applicable rules). In other cases, the rules on diminished value from the table apply.
** Software/digital content: returns are not possible if the seal is opened (sealed medium) or if digital content has been delivered electronically after the Customer’s explicit consent and confirmation of losing the right of withdrawal. Otherwise, the right of withdrawal applies.

Note: The deductions in the table are indicative; the final deduction is determined proportionately to the actual condition of the returned goods (damage, missing parts, use).

GENERAL WARRANTY TERMS

Govic Company d.o.o. supplies goods with the accompanying documentation and packaging as received from the distributor/manufacturer. To exercise a commercial (seller/manufacturer) warranty (if provided), it is necessary to enclose the invoice and, as instructed, any accessories that form part of the product, as well as a description of the fault to facilitate inspection.

The warranty does not cover defects and failures caused by improper handling, connection to unsuitable power sources, use under unintended conditions, unauthorised interventions, etc. Data stored on devices are not covered by the warranty. If the product has a warranty card issued by an authorised service centre, contacting that authorised service directly in accordance with the warranty terms is recommended.

Rights under a commercial warranty are without prejudice to the Customer’s statutory rights regarding lack of conformity and goods’ compliance with the contract.

Uncollected products from service: For products not collected by the Customer after service completion, the trader is responsible for 30 days. Thereafter, we reserve the right to charge storage fees (per the current price list, incl. VAT). If, even after additional notice and a reasonable deadline, the product is not collected, we will act in accordance with applicable regulations to settle incurred costs (e.g., sale of items and set-off).

3. PROTECTION OF USER/CUSTOMER DATA

The Govic Company Online Shop respects users’ anonymity and privacy and processes personal data in accordance with Regulation (EU) 2016/679 (GDPR) and applicable Croatian regulations. Data (e.g., name, address, OIB/PIN, phone, e-mail) are collected when voluntarily provided by the user, for the purposes of contract performance (order, delivery, payment), compliance with legal obligations, legitimate interest (prevention of abuse), or consent (e.g., newsletter).

The user has the rights to access, rectification, erasure (“right to be forgotten”), restriction of processing, data portability, and withdrawal of consent at any time (without affecting the lawfulness of processing before the withdrawal).
